Un-frigging-believable: fees for illegal amnesty paid by legal immigrants

Just when you thought you’d seen it all from the Obama administration, those folks manage to reach an even more amazing low. I cannot even find the words to explain this. There is irony and then there’s just plain “you gotta be kidding me.”

As reported by Townhall, “As the debate rages on Capitol Hill about how to defund President Obama’s executive action that gives legal status to 5 million illegal immigrants, it’s important to take a look at where the funding for his new amnesty program is coming from.”

“The funding for Obama’s executive action is coming through the United States Citizenship and Immigration Services, a fee, not tax based agency under the jurisdiction of Homeland Security. The larger question is, who is paying these fees?”

“Millions of legal immigrants are paying these fees, which are now being reallocated by the executive branch to legalize millions of illegal immigrants who have been living in the United States for years while failing to go through proper and long established legal channels to obtain citizenship or other legal status.”

Yes ladies and gents, President Obama will be using the fees paid by those who adhere to the rule of law in order to fund the unlawful, unconstitutional executive action to provide legal status to those who have disregarded our rule of law. You cannot make this up, and it highlights the incredible disrespect from this administration for the rule of law in order to advance its own political ideology and exploits.

Can you imagine someone who has spent countless years waiting and paying fee after fee to secure the prized title of “American citizen” only to now find out all they had to do was enter illegally — stay hidden, and have the same bestowed upon them. And to add insult to injury, the one seeking the proper legal means is now funding the one going about the same illegally.

According to the USCIS.gov website, here’s how it works:

U.S. Citizenship and Immigration Services (USCIS) is funded largely by application and petition fees. Recognizing that some applicants cannot pay the filing fees, USCIS established a fee waiver process for certain forms and benefit types. Demonstrated inability to pay is the only reason USCIS will approve a fee waiver.

Waiving a fee for one applicant transfers the cost of processing their application to other applicants through higher fees. Therefore, USCIS carefully considers the merits of each fee waiver request before making a decision.

To make it even worse, “On average legal immigrants wait ten years to fully obtain citizenship (and only after they’ve had a green card for five years) and they must pay thousands of dollars to USCIS in the process. Again, that money is now being used to give millions of illegal immigrants a free, expedited pass to legal status. Adding insult to injury, millions of green cards for illegals means longer wait times for legal immigrants.”

“At current staffing levels, USCIS issues about 1 million green cards per year. And when Obama enacted his first executive amnesty, the Deferred Action for Childhood Arrivals in 2012, wait times for legal immigrants to get their visas tripled from under five months to over 15 months.”

“Only about 1 million illegal immigrants were eligible to apply for DACA amnesty and only about 600,000 were given amnesty. Obama’s next amnesty, however, will reportedly allow up to 5 million illegal immigrants to apply and no one knows how many will take him up on the offer. But assuming the turnout for Obama’s next amnesty is bigger than DACA, we can safely assume that legal immigration delays will get much, much worse.”

This is just yet another example of the progressive socialist mantra of wealth redistribution. But to me this teeters on the edge of bureaucratic legalized plunder — something addressed by French economist Frederic Bastiat in his essay “The Law” – and if you haven’t read it, do it this week!

Yep, you’re probably saying this is unbelievable and it just cannot happen — but can it be stopped?

Well, based on what happened last week in the House GOP with the Cromnibus bill, I have my doubts — but there is a possibility. As we already discussed, Obama could just declare all DHS — and especially USCIS — services as essential in order to block any defunding.

But maybe here’s the answer. “According to the Congressional Research Service, Congress does in fact have the ability to defund the agency through the appropriations process. A fee-funded agency or activity typically refers to one in which the amounts appropriated by Congress for that agency or activity are derived from fees collected from some external source. Importantly, amounts received as fees by federal agencies must still be appropriated by Congress to that agency in order to be available for obligation or expenditure by the agency. In some cases, this appropriation is provided through the annual appropriations process. In other instances, it is an appropriation that has been enacted independently of the annual appropriations process (such as a permanent appropriation in an authorizing act). In either case, the funds available to the agency through fee collections would be subject to the same potential restrictions imposed by Congress on the use of its appropriations as any other type of appropriated funds.”

The issue becomes whether or not a new GOP-controlled House and Senate will make the stand — and I hope all of you who’ve earned American citizenship and those waiting will encourage Congress to do so. Sadly, based on the budget legislation that will certainly be signed by President Obama this week, he’ll receive some $2 billion in funding for his unlawful executive action — yes, it is unlawful because only Congress has the enumerated power to make rules or laws regarding matters of naturalization — the Constitution does not cede powers to the executive for being impatient. As we’ve reported previously, the Obama administration is ramping up in order to begin issuing “Green Cards” to illegals.

There are two horrific “policy” legacies with which Obama must not be allowed to saddle the American people — Obamacare and illegal immigrant amnesty. Those two endeavors will truly “fundamentally transform” our Republic. The clock is ticking and the American people have given the GOP the opportunity to begin reversing these dangerous ventures.

Obama came into office in 2009 with a full House and Senate Democrat majority. In the middle four years he lost the House majority — even as he won reelection. Now, in the final two years he has lost the legislative branch completely, and it’s time to begin the restoration of our Republic from the most left wing progressive socialist president we may ever know — unless America elects Senator Elizabeth Warren in 2016. I shudder to think…
