GAO says Bergdahl swap was illegal. Will Obama be indicted?

Just this week Texas Democrats in Travis Couny decided to indict Governor Rick Perry on charges of abusing his power, as we reported here. He duly turned himself in for booking and a mug shot, and looked pretty snappy in it.

Of course, nothing sticks on President Barack Hussein Obama. I’ve always maintained that if the “I-word” should be applied to Obama, there is no better instance than the unilateral decision to negotiate with terrorists for the release of the Taliban Five. It was a clear case of breaking the law.

But don’t take my word for it.

According to Fox News, “A nonpartisan government watchdog agency said Thursday that the Pentagon broke the law when it swapped five Taliban leaders for Army Sgt. Bowe Bergdahl earlier this year. The Government Accountability Office (GAO), in a legal opinion issued at the request of congressional lawmakers, said the Defense Department violated the law by failing to notify key Capitol Hill committees at least 30 days in advance. Further, the report said the Pentagon broke another law by using funds that were not technically available.”

So should we expect the Travis County DA to pursue indictment charges against Barack Hussein Obama, or Chuck Hagel — who adamantly defended the decision? Now, we all know it wasn’t Hagel’s decision to make — it was done by Obama. But ol’ Teflon Barack ain’t gonna have anything sticking to him.

Once again, the hypocrisy is outrageous. So, I’m waiting to hear from all you progressive socialists — abuse of power? Or is this just what America should expect from y’all — the double standard of integrity and duplicity when it comes to the rule of law. After all, that’s one of Saul Alinksy’s rules for radicals: force your opponent to live up to their standards, while not claiming any yourself. Just peachy.

At issue here were recent laws passed by Congress. The latest defense spending bill states that no money can be used to transfer Guantanamo prisoners to another country “except in accordance” with a separate, related defense law. That law requires the secretary of defense to notify key congressional committees at least 30 days before such a transfer.

As Fox reports, “When DOD failed to notify specified congressional committees at least 30 days in advance of its transfer of Guantanamo Bay detainees to Qatar, DOD used appropriated funds in violation of section 8111,” the report said. The GAO also said DOD violated the Antideficiency Act, which bars spending by agencies above the amount of money that Congress has obligated. In this case, the report said the Defense Department spent nearly $1 million more than it had.”

“Defense Department press secretary Rear Admiral John Kirby told Fox News Thursday night, “the operation to retrieve Sgt. Bergdahl was lawfully conducted and that was also the judgment of the Justice Department. Nothing has changed about our view that this was a lawful recovery operation.” The GAO said the law in this case is “clear and unambiguous.” The agency said that while the Defense Department defended the legality of the controversial swap, “in our view, DOD has dismissed the significance of the express language” in the law.”

Rear Admiral Kirby should immediately step down if he has problems with integrity, and anyway appears to be a uniformed mouthpiece for the Obama administration. I find it deplorable that a senior military officer would admittedly lie to the American people. You sir, are in violation of your oath to “support and defend the Constitution of the United States against all enemies foreign and domestic and to bear true faith and allegiance to the same.” It’s clear to all that your oath is to further the deceit and propaganda of the Obama administration.

Furthermore, Admiral Kirby, what is the status of the known deserter Bowe Bergdahl? Where is the 2010 classified Pentagon report on Bergdahl’s disappearance, which includes statements from his platoon mates? And why were the members of Bergdahl’s platoon forced to sign “nondisclosure agreements?”

So will the progressive media just brush this aside? Kinda hard to do in the same week that Democrats indicted a sitting GOP Governor claiming “abuse of power.”

Sen. Lisa Murkowski, R-Alaska, who was among the lawmakers who requested the report, said Thursday that the president “clearly defied” the law. “I hope this opinion by the nonpartisan Government Accountability Office sends a clear signal to the President that his recent shift towards unilateral action is not consistent with this nation’s principles and our carefully designed separation of powers.”

That principle of separation of powers is fundamental to this Constitutional Republic — but then again, we’re living in the Obamaworld of “fundamental transformation.”

Hey, you chuckleheads in Travis County, methinks you should just drop this case against Governor Perry, because you look like fools right now. Answer me this, is abuse of power and defying law acceptable for President Obama? Or will you hold him to the same standards to which you’re “claiming” to hold Governor Rick Perry?

Check and checkmate, chuckleheads.
